Anyone who is considering making a disability claim is probably also wondering whether or not to hire an attorney. The fact is, most people don’t do this on the initial claim. Instead, they wait until their disability claim is denied, and then hire an attorney to handle the appeal. This is counter-productive. Having an attorney from the very beginning of a disability claim helps make the process much easier and greatly increases the chances of success.
Never File a Disability Claim Without Consulting an Attorney
Dealing with the Social Security Administration (SSA) is difficult, and most people find it frustrating to try to go it alone. An attorney takes on much of the burden of dealing with SSA for the client, resulting in fewer worries for someone who already has enough to deal with in being disabled. Attorneys help clients file disability claims, work with them on obtaining the necessary proof and handle any appeals that are needed. Attorneys also assist clients in obtaining Supplemental Security Income (SSI) when appropriate.
Most attorneys do not take a fee up front to help a client deal with the SSA or get SSI. Instead, the attorney is paid out of the lump sum for back benefits that most clients receive once they are approved. If no lump sum is coming, then the attorney may take a percentage of the client’s monthly benefits until a certain agreed-upon amount has been paid.
