Disability Act

The USCAVC (United States Court of Appeals for Veterans Claims) exists to give disabled veterans a legal hearing to protest denied claims for benefits. In the past, there was no legal recourse when the board of appeals at the Department of Veterans Affairs decided to deny a claimfor disability compensation. Disabled veterans were then left with the choice to either give up or re-apply. Re-applying often meant going through the entire arduous process again, a process that could take years. Giving up meant an uncertain financial future, especially if the veteran in question was unable to work. The USCAVC was created to provide another forum for disabled veterans to have their cases heard.

However, even after the USCAVC was created in 1988, disabled veterans were unable to obtain legal counsel to assist them in any part of the claims or appeals process. Despite the tremendous difficulty of the process, lawyers were not permitted until a case actually came before the USCAVC. Recent acts to change legislation have now made it possible for lawyers to be retained by veterans right at the very beginning of the claims application process.
